Criminal Charges Against Serbian Officials

P R I S H T I N A

On basis of Article 148 paragraph 1 and Article 149 paragraph 1 of the Law of Penal Procedure, the Council for the Defence of Human Rights and Freedoms in Prishtina submits this

CRIMINAL CHARGE
for the criminal act of genocide based on Article 141 of the Tugoslay Penal Code against:
1.Slobodan Nhlosevic, President of the Republic of Serbia
2.Dr.Borieav Jovic, es-President of the Yugoslay Presidency
3.Lazar Mojsov, n-member of the Yugoslav Presidency
4.Ralf Dizdarevic, tx-President of we TUgOBLaV Presidency
5.Petar Cracanin, Federal Secretary of Interior Affairs
6.Radmilo Bogdanovic, ex-Ninister of Interior Affairs of the Republic of Serbia
7.Stanko Radmilovic, exeprime Minister of Republic of Serbia

For the following incriminated acts:

For a longer period of time, particularly from the begining of 1989 to thin day, with the intention of complete or partial annihilation of the Albanian nationality living in Kosova where it comprises about 90% of the total population, with premeditated, planned and organized action and acts carritd out as leading state and political of ficiala, after having presented a false Picture of the political and security situation in Kosova, have managed to iwpose states of emergency in this part of the territory of SPRY four times up to now, with the same continuing to this day without any preset time limit, although there were no constitutionally warranted circumstances for the proclamation of the same, and in such state of emergency brought about a complete lifting of the autonomy of Kosova, as well as the unconstitutional suspension of the Assembly of Kosova, its Executive Council, presidency and other state organs, even communal assemblies and their executive organs, after which every authority was taken over and exercised by the Serbian police, instigated and ordered killings to be committed, severe body woundings and injuries, severe violations of the phypical and psychological health of vast numbers of ciUxene of Albanian nationality, then various other economic, social, educational, health and other measures undertaken exclusively against Albanians, with, the intention of forcefully settling them out from the region and preventing their natural reproduction with repressive means, placed this whole nationality under such living conditions that lead to complete or partial extermination of Albanians, and thus with the intention of accomplishing such criminal policies up to this day have committed the following:

- 78 persons killed by firearms or physical torture by police and Yugoslav army units. in the period of 1989 to this day, bringing the cumulative number of those killed from 1981 to 97 persona;

- over 250 persons wounded by police firearms only during 1990 and 1991;

- a several thousands persons with severe body injuries caused by various other police tools such as machine-gun buts, truncheons, boots, helmets, etc;

- over 7000 persons primarily school children affected by the intoxication syndrome that has had serious detrimental effect on their psychological and physical health;

- a emergency managment has been imposed in over 360 enterprises, institutions, schools, hospitals, kindergartens, Red Cross institutions and other health, scientific and cultural ins titutions, due to which about 60.000 Albanians have been arbitrarily and illegally dismissed from work thus facing them and their families with direct hunger that could endanger their physical existence;

- many private shops and entail businesses owned by Albanians have been closed down for period ranging from 6 months to one year besides mandatory fines of 3000,00 dinars only because of participating in a one-day warning strike, thus seriously jeopardizing the private initiative and enterprise;

- humanitarian help in food and medicine has been made impossible whereas persons involved In organizing such help have been exposed to physical maltreatment and petty offence sentence, whilst confiscating such humanitarian help:

- financing of scientific, educational, cultural, pubLishing and media association have been cut off(Albanological Institute, Institutefor Textbook Publishing,elementary schools, high schools, etc.);

- in the period 1981-1989 politically implicated petty offence sentences have received 10.922 persons and this number has increased substantially in 1990 and 1991 (for displaying national symbols, reading and possesing legally published and distributed newspapers, for raising two Lingers
